Maharashtra Judicial Services Eligibility 2026: Age, Qualification and Practice Rule
Maharashtra Judicial Services eligibility depends on three things: a law degree, a practice or service condition, and an age limit counted from a fixed date. For the current recruitment, Advertisement No. 013/2026, the age date is 30 April 2026. A Supreme Court order of 21 August 2026 has also changed the practice condition, which makes this cycle different from the ones before it.
This page separates the rules that stay constant from the ones that apply only to the 2026 cycle. It also shows how the practice rule affects each type of candidate, so you can decide whether to apply before you open the form. The conditions are summarised from the advertisement and from reports of the court order, and you should check the final wording on the official MPSC website.

Maharashtra Judicial Services Eligibility

Minimum age | 21 years as on 30 April 2026 |

Nationality | Citizen of India |

Educational Qualification
You need a degree in Law from a university recognised in India. Both the three-year LL.B. and the five-year integrated law degree are normally accepted, provided the degree was awarded by a university or institution approved by the Bar Council of India. If your result is awaited, check whether the advertisement allows you to apply before the result, because the cut-off date for having the degree is stated in the notice.
A Master's degree in Law is not required. It also does not replace practice. The Supreme Court has said that time spent on an LL.M. does not count towards the practice requirement.
Practice and Service Requirement
What the advertisement says
Advertisement No. 013/2026 sets the practice condition by route. All durations are counted up to 30 April 2026.
Route | Condition in the advertisement |
|---|---|
Advocate | At least three years of practice in the Bombay High Court or subordinate courts, counted from provisional enrolment with the State Bar Council. Service as a law clerk after provisional enrolment is reported to count |
Public Prosecutor or Government Advocate | At least three years as a Public Prosecutor or Government Advocate, with earlier advocacy counted |
Court or law department staff | At least three years of service after the law degree in the High Court, subordinate courts, Government Pleaders' offices, or as Legal Assistant and above in the Law and Judiciary Department |
What the Supreme Court changed
The practice requirement has moved several times in the last two years, which is why older pages disagree with each other. The sequence below follows legal news reports of the orders.
Date | Development |
|---|---|
20 May 2025 | The Supreme Court restored a minimum of three years of practice at the Bar for Civil Judge (Junior Division) recruitment |
30 April 2026 | MPSC published Advertisement No. 013/2026 with the three-year condition |
22 May 2026 and July 2026 | The Court issued directions in the pending petition, and the Law and Judiciary Department wrote to MPSC. The application window was reported to reopen from 8 July 2026 |
21 August 2026 | The Court modified its 2025 ruling in Bhumika Trust v. Union of India (W.P.(C) No. 1110/2025) |
According to reports of the 21 August 2026 order, the position is now as follows.
Notifications up to 31 March 2027: All law graduates are eligible to apply, even without three years of practice. Candidates are deemed to have one year of practice.
Notifications from 1 April 2027: Candidates need one year of actual practice in the district courts, shown by a certificate of practice.
Selected candidates: Those appointed under the transitional scheme are reported to join as trainee judicial officers, with one year of training at the State Judicial Academy and one year of clerkship before confirmation. The training years count as practice at the Bar.
How MPSC applies the order to Advertisement No. 013/2026, including the revised closing date and the fresh-graduate age limit, was not confirmed in the sources we could verify. Read MPSC's revised notice before you pay the fee.
What this means for you
Your situation | What to do |
|---|---|
Practising advocate with three years or more | You meet the original condition. Keep your Bar Council enrolment and practice proof ready |
Practising advocate with less than three years | You are expected to be eligible under the transitional relief. Confirm in the revised notice |
Fresh law graduate | You are expected to be eligible in this cycle. Check the age limit and whether Bar enrolment is needed to apply |
Court or law department staff | Your three-year service condition remains in the advertisement. Keep your service certificate ready |
Age Limit and Relaxation
Age is counted as on 30 April 2026. You must have completed 21 years on that date. The maximum depends on your route.
Route | Minimum age | Maximum age (open) | Maximum age (reserved) |
|---|---|---|---|
Advocate, Public Prosecutor, Government Advocate | 21 years | 35 years | 40 years |
Court or law department staff | 21 years | 45 years | 50 years |
Reserved candidates receive the higher limit as per the Maharashtra government rules. For SEBC candidates, the relaxation follows the Bombay High Court orders cited in the advertisement, and EWS candidates who are not SEBC are not given that relaxation. The age limit for fresh graduates under the transitional relief was not stated in the sources we found, so use the revised notice for it.
Nationality, Domicile and Reservation
You must be a citizen of India. Reservation benefits are available only to candidates who are permanent residents of Maharashtra, and other candidates are treated as unreserved. If you claim reservation, you will need the caste certificate, a non-creamy layer certificate valid for the period stated in the notice and proof of domicile where required.
Marathi Language Requirement
Every candidate must be able to speak, read and write Marathi and translate between Marathi and English. This is a core requirement for the post, because Marathi is the working language of the state's subordinate courts. A Marathi proficiency certificate or equivalent proof is asked for at the interview stage. Candidates who have not studied Marathi formally should prepare for a translation test along with the law.
Conditions for Candidates with Disabilities
Candidates with a benchmark disability must submit a valid disability certificate and, where applicable, a UDID card. A scribe and compensatory time are reported to be available with prior approval. The qualifying marks for the interview are lower for these candidates, at 35 percent instead of 40 percent. Apply for approvals early, because they are processed before the examination and cannot be arranged on the day.
Who Is Not Eligible
No law degree on the stated date: A candidate whose degree is not recognised or not yet awarded cannot apply unless the notice allows it.
Outside the age band: Age is checked against the 30 April 2026 reference date, and a day over the limit is a rejection.
Insufficient service for staff candidates: Staff routes still need three years of service after the law degree.
Counting LL.M. as practice: Time spent in postgraduate study does not count.
No Marathi proficiency: A candidate who cannot meet the language requirement is not selected.
Mismatched or missing documents: Names, dates of birth and certificate details that differ across documents can lead to cancellation.
Fee and Documents
The fee reported in the advertisement is Rs. 394 for unreserved, EWS and orphan candidates and Rs. 294 for backward class and PwD candidates, plus bank charges. Documents are uploaded as PDFs, reported at 40 KB to 400 KB each. Keep ready your proof of date of birth, law degree and marksheets, Bar Council enrolment or service certificate, category and non-creamy layer certificates, disability certificate if applicable and Marathi proficiency proof.
Special Cases to Check
Some situations are not covered by a one-line rule. Check these before you decide.
Enrolled but not practising: Bar Council enrolment alone is not practice. If your advocate route depends on three years of practice, keep proof such as vakalatnamas, court orders or a certificate from a senior advocate or a court.
Law degree earned during a job: For staff routes, only the service after the date of the law degree counts, so do not include the years before it.
Law clerk experience: The advertisement is reported to count law clerk service after provisional enrolment, so keep the appointment letter and the High Court or judicial officer's certificate.
Name or date of birth differences: If your degree, school leaving certificate and Bar Council card show different spellings, get a gazette or affidavit correction before you apply.
Applying from another state: You can apply as an unreserved candidate if you are not a Maharashtra resident, but you must still meet the Marathi requirement.
Documents that prove your eligibility
Document | What it proves | Common problem |
|---|---|---|
School leaving or birth certificate | Date of birth for the age limit | Different date on another record |
Law degree and marksheets | Educational qualification | Provisional certificate only |
Bar Council enrolment certificate | Start date of advocacy | Provisional and final dates confused |
Service or experience certificate | Years of practice or service | Missing exact dates of joining |
Caste and non-creamy layer certificate | Reservation and age relaxation | Expired or out-of-period certificate |
Marathi proficiency proof | Language requirement | Obtained late, after the interview call |
